Court Ordered Conservatorship of FatherAcademy Award-winning actress Reese Witherspoon's father, Dr. John Witherspoon, has been placed under court-ordered conservatorship in Tennessee while the investigation continues into his mental capacity and alleged bigamous second marriage.The actress and her brother sought conservatorship because of their concerns over their father's mental health, which were brought to the family's attention by a newspaper announcement about Dr. Witherspoon's January 2012 wedding to Tricianne Taylor. Dr. Witherspoon is still married to the actress' mother, Betty Witherspoon, although the couple has been separated for 16 years. Court documents filed by Betty Witherspoon state that she learned her husband had entered into another marriage after seeing an announcement in the newspaper. She stated that when she asked her estranged husband about the marriage, he claimed he did not know Taylor nor did her remember marrying her. A conservatorship hearing likely became necessary because Dr. Witherspoon had probably not prepared a durable power of attorney for finances and health care in advance, as part of a comprehensive estate plan. Usually this is the case when families have to go to court to request the appointment of a conservator or guardian, which can be a costly and time-consuming endeavor - and, as evidenced by the wide press coverage, a public one as well. The best way to avoid a conservatorship is to have an estate plan prepared far in advance, while established as "competent". You also need a Durable Powers of Attorney before a health care crisis, so your own agent can step in to make the necessary financial or health care decisions for you.
